POS Equipment Purchase Agreement Installment Pay

THIS AGREEMENT is made on _______________________ (date) by and between Card One International, Inc. (“Card One”) and ___________________________________ (“Merchant”) that signs this Agreement. WHERE AS:Card One is in the business of selling Point of Sale (POS) credit card processing terminals; and WHERE AS: Merchant agrees to purchase a POS credit card processing terminal from Card One under the following terms and conditions; and NOW THEREFORE, in consideration of the representations and mutual covenants made herein, the parties hereto agree as follows:

4. Card One shall ship POS terminal when 1st installment has been deposited.

5. Merchant may not assign this agreement, or any rights hereunder, without the prior written consent of Card One.

6. Merchant agrees this POS terminal purchase is non-cancelable and non-refundable. Should Merchant default on payments, Merchant hereby authorizes Card One to debit Merchant’s checking account.
